These Terms and Conditions ("Terms") govern your access to and use of idahofallsflooring.com and its related pages, content, forms, and features (collectively, the "Website"). The Website is operated by Classic Flooring LLC ("Classic Flooring," "we," "us," or "our").

By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Website Purpose

The Website provides general information about Classic Flooring, flooring products, installation, hardwood resanding and refinishing, projects, service areas, and related topics. Website content is for general informational and promotional purposes only.

The Website is not a substitute for an in-person assessment, product specifications, installation instructions, maintenance guidance, manufacturer documentation, or a written agreement tailored to a particular project.

2. Eligibility and Authority

You must be at least 18 years old and legally capable of agreeing to these Terms to use any Website feature that submits information to us. If you use the Website for a company, property owner, household member, or another person, you represent that you are authorized to act for that person or entity with respect to the request.

3. Quote Requests and Communications

The Website may allow you to request a free quote or contact us. You agree to provide accurate, current, and complete information and to update or clarify it when reasonably necessary.

A Website submission is only a request for contact. It is not an offer, acceptance, contract, reservation, guarantee of availability, or commitment to perform work. We may accept, decline, or request more information about an inquiry in our discretion, subject to applicable law.

By providing contact information, you authorize us to respond about your inquiry or project by email, telephone, or text. Your submission does not by itself authorize automated marketing calls or texts where separate consent is required. Carrier messaging and data rates may apply to text communications.

4. Bids, Estimates, and Project Agreements

Any bid, estimate, proposal, scope of work, change order, invoice, warranty, payment term, installation schedule, or other project document is governed by its own terms. If a separate written agreement conflicts with these Terms concerning products or services, the separate written agreement controls for that product or service.

Unless stated in a signed writing:

  • Website descriptions and preliminary discussions do not create a binding price or scope;
  • Measurements, quantities, subfloor conditions, access requirements, product availability, freight, taxes, disposal needs, and site conditions may affect price and timing;
  • A project is not scheduled until the parties complete the applicable approval and scheduling process; and
  • Changes to product selection, quantities, site conditions, or scope may require a revised bid or written change order.

5. Products, Samples, and Visual Representations

Flooring is subject to variations in color, grain, pattern, texture, dye lot, sheen, dimensions, and appearance. Natural wood and other materials may change over time because of light, humidity, temperature, use, maintenance, and other conditions.

Website photographs, screen colors, samples, room scenes, product names, and descriptions are illustrative and may not exactly represent the product installed in a particular space. Product availability, specifications, pricing, and manufacturer programs may change without notice. You should review current physical samples and manufacturer information before making a final selection.

References to third-party brands, certifications, or warranties are informational. Manufacturer warranties, if any, are provided by the manufacturer under its terms and are separate from any warranty Classic Flooring provides in a written agreement.

6. Services and Site Conditions

Installation, repair, resanding, refinishing, and related work depend on site-specific conditions. Conditions such as moisture, subfloor integrity, existing flooring or adhesives, structural movement, access, utilities, climate control, hazardous materials, hidden damage, and work by other trades may affect feasibility, schedule, cost, appearance, or performance.

The Website does not promise a particular project result. Project obligations, preparation requirements, exclusions, tolerances, warranty coverage, and remedies are determined by the applicable written agreement and law.

7. No Online Sale or Payment Processing

The Website displays products and services but does not, as currently configured, complete an online flooring sale or process project payments. A Website form submission does not purchase a product, authorize a charge, or establish payment terms.

If online ordering, financing, or payment features are added, additional terms and third-party terms may apply and will be presented as appropriate.

8. Reviews, Testimonials, and Project Content

Reviews, testimonials, project descriptions, and photographs reflect individual experiences and circumstances. They are not guarantees that another customer or project will have the same result.

If you voluntarily send us feedback, ideas, photographs, or other material, you represent that you have the right to provide it. We may use non-confidential feedback to improve our business. We will obtain any permission required by law before using identifiable customer content for advertising or public promotion.

9. Privacy

Our Privacy Policy describes how we collect, use, and disclose Website-related information. By using the Website, you acknowledge that information will be handled as described in that policy and applicable law.

Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable right to access and use the Website for lawful, noncommercial informational purposes. You may not copy, reproduce, modify, distribute, publish, display, sell, license, create derivative works from, or otherwise exploit Website content without prior written permission, except as permitted by law.

Classic Flooring's name, logo, service names, and related marks may be trademarks of Classic Flooring or others. No license to use a mark is granted by implication. Third-party names and marks belong to their respective owners.

12. Third-Party Services and Links

The Website may use or link to services operated by third parties, including Webflow, Google Analytics, Google reCAPTCHA, Google Maps, Adobe Fonts, Facebook, Instagram, YouTube, review platforms, product manufacturers, and distributors.

Third-party services are governed by their own terms and privacy notices. We do not control and are not responsible for third-party content, products, services, availability, accessibility, security, or practices. A link or reference does not necessarily constitute endorsement. You use third-party services at your own risk.

13. Website Accuracy and Availability

We try to keep Website information useful, but we do not guarantee that content is complete, current, accurate, or error-free. The Website may contain typographical errors, outdated information, broken links, or content supplied by others.

CLASSIC FLOORING DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

CLASSIC FLOORING DOES NOT WARRANT THAT THE WEBSITE WILL BE SECURE, COMPLETE, CURRENT, FREE OF HARMFUL COMPONENTS, OR AVAILABLE AT ALL TIMES. YOUR USE OF THE WEBSITE IS AT YOUR OWN RISK.

These disclaimers apply to the Website. They do not replace or limit an express written product or service warranty, or a duty that cannot lawfully be disclaimed.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLASSIC FLOORING AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND WEBSITE SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, CLASSIC FLOORING'S TOTAL LIABILITY FOR A CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Liability relating to flooring products or services is governed by the applicable written agreement and law.

16. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Classic Flooring and its owners, members, managers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Website, your material violation of these Terms, your infringement of another person's rights, or content you submit through the Website.

Classic Flooring may control the defense of a matter subject to indemnification, and you agree to cooperate reasonably. This section does not require you to indemnify Classic Flooring for conduct for which indemnification is prohibited by law.

17. Governing Law and Venue

These Terms and disputes arising out of or relating to the Website or these Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.

Except where applicable law requires otherwise, exclusive jurisdiction and venue for such disputes lie in the state or federal courts serving Bonneville County, Idaho, and you consent to their jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time by posting a revised version and changing the "Last updated" date. Changes are effective when posted unless otherwise stated. Your continued use of the Website after updated Terms take effect constitutes acceptance of the revised Terms.

19. General Terms

If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as permitted by law. Headings are for convenience only. The words "including" and "such as" mean "including without limitation."

These Terms and the Privacy Policy are the entire agreement between you and Classic Flooring regarding use of the Website. They do not replace any bid, proposal, purchase agreement, installation agreement, change order, warranty, financing document, or other agreement that separately applies to products or services.
